Agreement to Terms

By accessing or using zakki (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the Service.

Description of Service

zakki is a mobile application that allows you to:

• Record: Save text and images as casual, unstructured records
• AI Access via MCP: Enable AI tools to read your records through the Model Context Protocol (MCP)

Account

• You must create an account to use the Service
• You are responsible for maintaining the security of your account credentials
• You must provide accurate information when creating your account
• One person may not maintain more than one account

User Content

• You retain all intellectual property rights to the content you create and store in zakki
• By using the Service, you grant us a limited license to store, process, and transmit your content solely to provide and improve the Service
• We do not use your content to train AI models
• You are responsible for the content you store and must not use the Service to store illegal content

Subscriptions and Payments

Free Plan

• Basic access to the Service with usage limits
• No payment required

Premium Plan

• Enhanced features and increased limits
• Billed monthly through Apple App Store or Google Play Store
• Managed by the respective app store’s subscription system
• You can cancel at any time through your app store subscription settings

Refunds are handled according to the policies of Apple App Store or Google Play Store.

Prohibited Uses

You agree not to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to other users’ data
• Interfere with or disrupt the Service
• Reverse engineer the Service
• Use the Service to store or distribute malware

Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied.

Limitation of Liability

To the maximum extent permitted by law, CAPH TECH shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Japan, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court.

Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes through the Service. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.
